These terms (the Terms) are the contract between GPUBank SAS (GPUBank, we) and the person or company that opens an account (you). They cover gpubank.io, the console at console.gpubank.io, the API, the CLI and every GPU, disk, endpoint or job you run through them (together, the Service).

If you accept them on behalf of a company, you confirm that you may bind it. The Privacy policy explains what we do with data and is part of this contract.

• Pods (interactive machines), jobs (run to completion) and endpoints (OpenAI-compatible inference, in beta) on the GPUs listed on the live board, in Paris, Frankfurt, Ashburn and Singapore.
• Every hourly price includes the vCPU, the RAM, the local NVMe scratch, one public IPv4 and traffic in and out. The persistent disk is the only other line, at $0.07 per GB-month.
• Stock is shown live. A line marked queue is out of stock in that region: your launch waits, and nothing is billed until it runs.
• Features marked beta or soon may change or be withdrawn. They are never billed for what they do not deliver.

We can change, add or retire GPU types, templates, regions and features. A retirement that affects a resource you run is announced 30 days ahead, unless a hardware or security issue leaves no choice.

• You need a working email address, a password of at least 12 characters, and to be 18 or older or acting for a business.
• Your account is personal: do not share it. Invite teammates from the console; each keeps their own credentials, and you remain responsible for what your workspace does.
• API keys, webhook secrets and SSH keys are yours to protect. Rotate a key the moment you think it leaked; anything done with a valid key counts as done by you.
• Keep your details accurate: the country and, for companies, the VAT ID go on your invoices.
• Signing in with GitHub or Google is optional. It creates the same account, under the same rules.

Tell us at once at [email protected] if you notice access you did not authorise. We will help you lock the account down.

• The meter starts when a resource passes its health check and stops the second you stop or delete it. Launch, health check, a failed start and a host failure are not billed.
• A stopped pod bills its persistent disk only, at $0.07 per GB-month pro-rated to the second, until you delete the disk.
• Interruptible pricing is about 40 % below on-demand. We can reclaim an interruptible resource with a five-minute notice; it is stopped, never deleted, and the checkpoint hook fires first.
• Reserved capacity is a fixed price for a week or a month, physically allocated to you and prepaid from your balance. It can be cancelled before it starts; once started it is not refundable, except where the law requires.
• Prices are in USD, VAT excluded. VAT is applied according to your country and VAT ID and shown on the invoice.

Price changes. A cut applies to running sessions the moment it takes effect. An increase is announced at least 30 days ahead and never applies to a session that is already running. Reserved capacity keeps its price for the whole term.

Receipts and invoices. Every session gets a receipt with its seconds and its amount; a monthly invoice groups them. Both live in the console and export as CSV or JSON. Tell us within 30 days if a line looks wrong and we will go through the session log with you.

• Top-ups are from $25 to $5,000 per payment, settled in cryptocurrency: Monero straight into our wallet, or another coin converted by an exchange at the floating market rate. The amount to send is shown once and stays valid for 60 minutes.
• The balance is credited in USD at the face value of the top-up. A single top-up of $500 or more gets a 2 % bonus credited with it.
• Credits (top-up bonuses, service credits, referral rewards) are spent before your own money and are never withdrawn or paid out. New accounts start at $0: the first step is a top-up.
• A payment we cannot credit, because it is late, short, a different amount or on a route we refuse, is returned within 72 hours to the refund address you gave on the payment page, minus the network fee. Give an address you control.
• The balance is not refundable, except where consumer law requires it. Unspent balance on a closed account is handled in section 10.
• When the balance reaches $0, running pods and jobs stop. Disks are kept 14 days so you can top up and resume; after that they are deleted.
• Ticketed support is for funded accounts: opening a ticket needs a balance of at least $25, the minimum top-up. Email support stays open to everyone.

You may not use the Service to:

• break the law or the rights of others, including intellectual property and privacy rights, or process personal data without a legal basis;
• attack, scan, flood or interfere with any network, service or machine, including ours;
• mine cryptocurrency or run proof-of-work of any kind;
• send spam, or host phishing, malware or command-and-control infrastructure;
• generate, store or share child sexual abuse material, or content that incites violence or terrorism;
• circumvent quotas, metering or the deposit rules, or resell capacity as your own service without our written agreement;
• run workloads subject to export controls without the required authorisation.

We do not look inside your workloads. We act on abuse reports, on signals such as outbound attacks or sanctions screening, and on legal orders. Depending on the case we warn you, stop the resource, or suspend the account; unlawful content is preserved for the authorities where the law requires it. Report abuse to [email protected].

• You own your data, models, weights, prompts and outputs. You grant us only the right to store and process them as needed to run the Service.
• We do not access the content of your disks, buckets, logs or endpoints, except with your consent for support, to act on an abuse report, or under a legal order, and we tell you when the law allows it.
• Persistent disks and buckets live in the region you chose. EU regions stay in the EU; disks never move unless you move them.
• Deleted data is removed from active storage immediately and from backups within 30 days.
• Keep your own copies of what matters. Our storage is replicated, but no storage replaces your backups.

Business customers who process personal data on the Service are covered by our Data Processing Agreement, described in the Privacy policy, section 12.

• On-demand and reserved resources target 99.9 % monthly availability per region; the measured figures are on the status page.
• A host failure that stops your resource credits the interrupted session in full. An interruptible reclaim without its five-minute notice credits the last 30 minutes of that session.
• A regional incident credits every affected session, applied automatically to your balance and listed on the status page with a post-mortem.
• Planned maintenance is announced 7 days ahead, outside the region's business hours, and never stops a running on-demand resource without notice.

Credits are the remedy for availability shortfalls; they are added to the balance and cannot be paid out. Beta features carry no availability target.

• Nothing here limits a liability that cannot be limited by law: death or personal injury caused by negligence, fraud, or the mandatory rights of consumers.
• Our total liability for all claims in any 12-month period is capped at the amount you paid us in the 3 months before the event, or $100, whichever is higher.
• We are not liable for indirect losses: lost profits, revenue, data or goodwill, or the cost of substitute services.
• The Service is not designed for life-critical or safety-critical use. Do not run systems on it where a failure could hurt someone.
• You are responsible for your workloads and their outputs, including what your models generate and whom you serve them to.

• You can close your account from the console at any time. Running resources stop, disks are deleted after 14 days, and your data export stays available for 30 days.
• Unspent balance on a closed account: credits are forfeited; money you topped up is not refunded, except where consumer law requires it, in which case it is returned in the cryptocurrency you paid with, to an address you provide, minus network fees.
• We can suspend or close an account for a breach of section 6, for fraud, for an attempt to reverse a payment, or under a legal order. We notify you by email, with the reason, unless the law forbids it.
• Sections 7, 9 and 12, and any amount due, survive closure.

• Each version carries a number and an effective date; the history is at the bottom of this page.
• A change that reduces your rights or adds obligations is announced at least 30 days ahead by email and in the console. You can close the account before it applies.
• Corrections, clarifications and changes required by law can apply sooner. They are still dated and listed.

• These Terms are governed by French law.
• Before any court, write to [email protected]: we answer within 15 business days and try to settle. Business customers agree to the exclusive jurisdiction of the courts of Paris.
• If you are a consumer in the EU, you keep the mandatory rights of your country of residence, may bring a claim before your local courts, and may use the European online dispute resolution platform. The 14-day right of withdrawal applies to a top-up that has not been spent; by launching a resource you ask us to start performing immediately, for the amount consumed.
• If one clause is invalid, the rest stays in force. These Terms and the Privacy policy are the whole agreement. They are written in English, and the English version prevails over any translation.
